Subject: Care of Mrs Evelyn Lovelock

This is a follow-up to my letter ref SUEM1.RTF 23rd December 2002 in which I informed you and others of the latest situation regarding my mother's case, and the availability of information on the two web sites above.

I am taking your letter of 19th December, 2002 as a formal rejection of my claim for free continuing care for my mother under the complaints procedure. I was about to submit a formal request to the Appeals Convenor of your PCT for an external enquiry when my legal adviser received notification that the NHS as a whole accepted 100% financial responsibility for the typical Alzheimers patient in his Dorset case.

I hope you will now reconsider, but I am sending a copy of this to your Appeals Convenor asking for an external hearing on the grounds that those defined by Page 9, Section 1, of your criteria are as a matter of law under the Coughlan case entitled to 100% free care from your PCT irrespective of what your criteria say. This is done as a protective measure to keep within any time limit, but I am happy that you should have time to consider the implications.

My legal adviser, Mr Derek Cole, M.A. (Law), LL.B (Cantab) is considering the latest developments and will send you the full documents, including the 30 page Ombudsman's Dorset finding, as soon as possible. This letter does not preclude anything he may later put forward. More details are available on the two web sites above.

Nothing in this letter modifies or reduces in any way my claim for 'free continuing care' under the Coughlan Case for my mother.
